Legal Acts:  Amendements to the Laws on Traffic; on Social Insurance; on Health Insurance; on Environmental Protection; on Labor Code; on Customs Code; on Urban Planning and Construction Code

According to the amendments, a certain part of the funds received by relevant institutions must be transferred to the state budget (previously these funds were distributed only among those institutions).

 

Some of them are as follows:

 

  1. 93% of funds received from penalties for violation of traffic rules, escort of vehicles and other additional paid services are transferred to the account of the Baku Transport Agency while remaining 7% to the state budget

 

  1. 43% of financial sanctions for violating the requirements of the laws on Social Insurance and Health Insurance, 23% of the amount of accrued interest for the delay in paying insurance premiums are transferred to the relevant structures, while 7% to the state budget

 

  1. 18% of the amount of penalties imposed for violation of labor legislation are transferred to the account of the Ministry of Labor and Social Protection and 7% to the state budget

 

  1. 7% of funds received by the State Environmental Protection Fund are transferred to the state budget

 

  1. 7% of the cost of services for verification of compliance of construction projects with urban planning documentation and the provision of other services in the field of construction activities is transferred to the state budget

 

  1. 93% of the funds received from the sale of goods and vehicles transferred to state ownership on the basis of court decisions on cases of crimes identified by customs authorities and fines for violation of customs regulations are transferred to customs authorities, and remaining 7% to the state budget

 

The procedure for utilization of these funds is determined by the Cabinet of Ministers.

 

Legal Act: Procedure for organizing video reception of citizens in the Administration of the President of the Republic of Azerbaijan

This document establishes the rules for applying for video receptions and their conduct as well as addressing appeals made during video receptions.

Each month, the Presidential Administration publishes a reception schedule,  announced in media in advance. A citizen can sign up for a video call using ID documents.

Video reception is carried out through the reception of citizens in the local executive authority.

Citizens' appeals are registered in the electronic information system, also a list of appeals is compiled.

Legal Act: Amendments to the Decision on Amendments to the Commodity Nomenclature of Foreign Economic Activity, Rates of Import Customs Duties and Rates of Export Customs Duties

The rate of import customs duty for medical masks / respirators and sterile / non-sterile gloves is set at 0% until 1 July (previously it was 1 June).

 

Legal Act: Decision on Approval of the list of licenses and permits, information on the issue, suspension, restoration or cancellation of which is to be sent to the State Customs Committee

List of licenses and permits, information on the issue, suspension, restoration or cancellation of which is to be sent to the State Customs Committee has been determined.

This list includes the following:

  1. Licenses

 

  • import, export and transit of precursors
  • transportation of dangerous goods through transport
  • import of plant protection products and agrochemicals

 

  1. Permits

 

  • transportation of dangerous goods
  • certificate of the introduction of a special economic regime for export-oriented oil and gas activities
  • agreement on the organization of regular intercity transportation by road
  • investment promotion certificate

Legal Act: Law on Amendments to the Criminal Code

Effective date: 1 June 2020

 

According to the amendments:

  1. The acts provided for in a number of articles will be completely decriminalized, and in crimes against the property and economic activities, the amount of damage caused by liability will be increased, and acts up to that extent will be decriminalized and considered as an administrative offense.

 

  1. A number of penalty limits have been reduced.

 

  1. A person who committed the crimes provided for in Articles 178.2, 179.2, 186.2.1, 189-1.2-1 of the Criminal Code and reconciled with the victim may be released from criminal liability in the event of payment to the state budget of the amount of 25% of the damage as a result of the crime instead of previously defined full cost of the damage.

 

  1. A person who committed the crimes provided for in Articles 178.3, 178.4, 179.3, 179.4 of the Criminal Code and reconciled with the victim may be released from criminal liability in the event of payment to the state budget in the amount of 50% of the damage as a result of the crime instead of previously defined twice the cost of the damage.

 

Legal Act: Law on Amendments to the Code on Administrative Offences

Effective date: 1 June 2020

 

According to the amendments:

  1. A new Chapter 41 has been added to the Code on Administrative Offences called “Administrative offenses against military service”.

 

  1. Military personnel cannot be subject to an administrative arrest, with the exception of administrative offences provided for in Chapter 41 of the Code on Administrative Offences.

 

  1. As a result of decriminalization of a number of actions and their removal from the Criminal Code, the following articles have been added to the Code on Administrative Offence:

 

  • “198.2. Infringement of safety precautions regulations or other rules of labor safeties committed by a person, to whom these rules are assigned, and as result brought to minor harm to health of a person”

 

  • “198.3. If the act provided for in Article 198.2 of this Code caused less serious harm to the health of a person”

 

  • “232-1. Deliberate destruction or damage of property” (decriminalized in part)

 

  • “215.4. Admission to medical and pharmaceutical activities of persons (workers) who have not passed certification in accordance with the law”

 

  • “351-1. Reduction to unsuitability of vehicles or means of communication” (decriminalized in part)
